Terms of Service

1. Agreement

By accessing or using PEMOS ("the Service"), operated by EOSE Inc. ("we", "us"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

PEMOS provides a dedicated, single-tenant AI workspace deployed on isolated cloud infrastructure. Each instance is provisioned exclusively for one customer with dedicated compute, storage, and network resources.

3. Account & Access

You are responsible for maintaining the confidentiality of your access credentials. You agree to notify us immediately of any unauthorized access. We reserve the right to suspend access for security reasons.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to access other customers' instances or data
• Reverse engineer, decompile, or disassemble the Service
• Transmit malware, viruses, or harmful code
• Exceed usage limits or circumvent rate limiting
• Resell access without written authorization

5. Data Ownership

You retain full ownership of all data you store in your PEMOS workspace. We do not access, analyze, sell, or share your workspace data. Your data resides in your chosen region and is not commingled with other customers.

6. AI-Generated Content

Content generated by AI agents is provided as-is. You are responsible for reviewing and validating AI outputs before relying on them for decisions. We make no warranties regarding the accuracy, completeness, or fitness of AI-generated content.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted service. Planned maintenance will be communicated in advance. We are not liable for downtime caused by third-party providers (Azure, Anthropic, etc.).

8. Payment & Billing

Paid plans are billed monthly in advance. Prices are subject to change with 30 days' notice. Non-payment may result in service suspension after a 7-day grace period. No refunds for partial months.

9. Termination

Either party may terminate with 30 days' written notice. Upon termination, you may export your workspace data within 30 days. After that period, data will be permanently deleted.

10. Limitation of Liability

To the maximum extent permitted by law, EOSE Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect.

12. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada.
